I Have Two Problems With This

Facebook says it's not liable for false "fact checks" used to censor, because they're “protected opinion" (reclaimthenet.org)

Wait, what?

Back up. Let’s start at the beginning.

John Stossel, a libertarian journalist and author, filed a lawsuit against Facebook, claiming the platform defamed him through a “fact check” label. Facebook added a “misleading” label on a video he posted.

Stossel was censored on Facebook and his work was undermined by the “fact check” that he alleged was defaming his character by falsely accusing him of lying.

Hmm. Okay. And how did Facebook respond? Ah, here’s the part I have trouble with.

In recent court filings, Facebook’s attorneys argued that the “fact check” on the video was an “opinion” and not an actual fact.

Libel law protects opinions from defamatory liability.

We obtained a copy of the filing for you here.

“The labels themselves are neither false nor defamatory; to the contrary, they constitute protected opinion,” Facebook’s lawyers wrote in the court filings.

So, if they’re “protected opinion” doesn’t that mean they’re not actually fact checks?

And if they’re saying that “protected opinion” is free speech, doesn’t that kind of hurt their argument for censoring Stossel in the first place? If their fact check is “protected opinion”, how in the world does that tag not apply to Stossel’s post?

Just a thought.

Facebook wants the ability to allow fact checkers to accuse their users of lying and censor and ban users based on those “fact checks,” but not to have any liability for accusing those users of lying.

Well, I don’t know if that’s legal, but it’s certainly not just.

Federal Judge Blocks Texas’ Enforcement of the First Amendment

That’s how I read it anyway.

Federal Judge Blocks Texas Social Media Censorship Law, Abbott’s Office Slams Move As ‘Hostile’ To America’s Free Speech Foundation | The Daily Wire

On Wednesday, a federal judge granted a preliminary injunction against a Texas social media “censorship” law which would prevent Big Tech giants like Twitter and Facebook from blocking content or banning users based on political viewpoints.

In September, Texas Governor Greg Abbott signed HB20 into law. “There is a dangerous movement by some social media companies to silence conservative ideas and values,” said Abbott at the time. “This is wrong and we will not allow it in Texas.”

Judge Robert Pitman for the Western District of Texas granted the preliminary injunction and said that Big Tech companies have a First Amendment right to moderate content on their platforms.

No, that’s not how the First Amendment works. You have it completely backwards. I have a First Amendment right to have my voice heard.

Actually, this is an interesting case. I hope it makes its way to SCOTUS. As far as I know, the Court has  not weighed in on freedom of speech and Social Media. I’d love to hear what they have to say.

Once Again We Return to Loudoun County

Man, this is one screwed up school district.

Virginia Judge Sides With Teacher Suspended After Opposing Loudoun Transgender Policy, Can’t Be Punished for Beliefs | The Daily Wire

He was suspended for voicing his opinion on a proposed policy at a school board meeting.

Umm..isn’t that the point of school board meetings? To provide input on proposals so that they can be improved or discarded?

A Virginia judge granted a permanent injunction protecting the speech rights of a Loudoun County teacher who was placed on leave last May following remarks at a school board meeting about a proposed transgender policy.

The ruling blocks the Loudoun County School Board from punishing Tanner Cross, a physical education teacher at Leesburg Elementary School, for his views about Policy 8040, which is the district’s transgender policy.

“Teachers shouldn’t be forced to promote ideologies that are harmful to their students and that they believe are false, and they certainly shouldn’t be silenced from commenting at public meetings,” said Tyson Langhofer, a lawyer with Alliance Defending Freedom who has been representing Cross.

“While we are very pleased that Tanner will be able to keep serving his students in light of this settlement, the concerns expressed in our ongoing lawsuit challenging the district’s policy remain,” he added.

Cross spoke up at a school board meeting in May, saying that he did not support Policy 8040, which was being considered at the time. Soon after the meeting, he was placed on administrative leave.

How did they think they could get away with this? This is a clear trampling of his First Amendment rights. It was at a school board meeting, not in class. He wasn’t out picketing in front of the school building. He didn’t even (as far as I can tell) say he would not adhere to the proposal if it passed. He said he shouldn’t have to, but didn’t say he wouldn’t.

This is tyranny. And we’re all just happy to go along.

We Need More of This

Senator Elizabeth Warren is sued for violating First Amendment over Amazon book censorship calls (reclaimthenet.org)

When politicians violate the First Amendment, we need to slap them down hard.

A lawsuit has been filed against Sen. Elizabeth Warren (D-MA) because of a letter she sent to Amazon, accusing the Big Tech giant of “peddling misinformation.”

The lawsuit claims she violated the First Amendment by sending the letter.

In September, Sen. Warren sent a letter to Amazon accusing it of peddling misinformation by promoting books spreading “falsehoods” about COVID-19. She said that the retailer’s algorithms had been recommending books promoting what she thinks is the wrong type of treatment.

She’s basically telling Amazon what they can sell and promote. That is a clear First Amendment violation.

“This pattern and practice of misbehavior suggests that Amazon is either unwilling or unable to modify its business practices to prevent the spread of falsehoods or the sale of inappropriate products—an unethical, unacceptable, and potentially unlawful course of action from one of the nation’s largest retailers,” Warren wrote in the letter.

Hopefully the answer is “unwilling” and that they remain so, despite pressure from the government.

This Is 100% True and Ought to Scare Everyone

The Purpose Of The Jan. 6 Select Committee Is To Suppress Free Speech (thefederalist.com)

The final three paragraphs are quite blunt and worth quoting in their entirety.

If our news media had any interest in holding power to account, the headlines and coverage would have focused instead on how Democratic lawmakers on the committee, together with NeverTrump GOP Reps. Liz Cheney, R-Wyo., and Adam Kinzinger, R-Ill., are using their subpoena powers to target law-abiding Americans who wished to exercise their right to peacefully assemble and protest.

Let’s be clear on this point. Since its inception, the Select Committee has amounted to a show-trial for House Democrats and leading NeverTrumpers who are attempting to make examples out of ordinary citizens who dared to protest the election, just as President Biden’s Justice Department is throwing the book at anyone connected to the events of Jan. 6 to make examples of them.

The message is clear: if you protest, if you exercise your First Amendment rights for a cause that those in power have not approved, you will be targeted by the government, smeared and harassed by the media, and made into a spectacle — pour encourager les autres.

This is a direct assault on the First Amendment by Speaker Nancy Pelosi (D-CA-11) and her cohorts in the House.

Pretty Sure This Is a Direct Assault on His First Amendment Rights

Kentucky Cop Punished For Praying In Front Of Abortion Clinic Sues City | The Daily Wire

A Kentucky police officer who was placed on administrative leave for months over a morning he spent praying outside a Louisville abortion clinic while off-duty is suing both the police department and the city.

Officer Matthew Schrenger filed a federal lawsuit on Monday accusing the city of Louisville and the Louisville Metro Police Department of violating his constitutional and civil rights, including his First Amendment rights.

“A quiet, off-duty prayer, on a public sidewalk, resulted in Schrenger being immediately suspended for over four months, stripped of his police powers, and placed under investigation,” the complaint states.

The suit names Police Chief Erika Shields, the Louisville Metro Police Department, Mayor Greg Fischer, and the City of Louisville, Kentucky as defendants.

Yeah, I would expect this to be settled out of court quickly and quietly. Not sure the defendants have a leg to stand on, and this is something they definitely don’t want to have to defend in public.

I’d Put This Under the ”Well, Duh” Category

Judge rules Wisconsin sheriff's office violated First Amendment by ordering student to delete Instagram post (reclaimthenet.org)

This is pretty clearly stated and is 100% correct.

The court has ruled that Sheriff Joseph Konrath violated the First Amendment by sending Sergeant Klump to threaten Amyiah’s parents.

The ruling starts by stating: “The SARS-CoV-2 virus and COVID-19 have had a tremendous impact on American society. But, as this case makes clear, that impact has its limits and, more specifically, does not extend to overriding the protections of the First Amendment…

“The parties agree that the facts are not disputed. Indeed, the entirety of Sergeant Klump’s encounter with Amyiah and her parents is captured in a dash-cam video. That video, along with other record evidence, establishes that Defendants violated Amyiah’s free-speech rights by demanding that she take down her social media posts or face criminal citation or arrest,” the ruling continued.

“Even if short and often grammatically scurrilous, social media posts do not fall outside the ambit of the First Amendment. To the contrary, they are exactly what the First Amendment seeks to protect.”

Can’t argue with that. Glad one judge gets it, at least.

Coming From Twitter, this is Rich

Twitter Suing Texas AG Over Probe Into Trump Ban, Company Cites ‘First Amendment Rights’ | The Daily Wire

Just read this and try not to laugh (emphasis mine):

Twitter is suing Texas Attorney General Ken Paxton, a Republican, seeking to halt his state’s investigation into the Big Tech company’s move to ban President Donald Trump from its platform.

Paxton launched a probe into Big Tech’s apparently coordinated deplatforming of Trump in January.

Twitter is claiming they were “targeted” by Paxton as a form of retaliation for exercising their “First Amendment rights.”

So, Twitter has First Amendment Rights, but President Donald Trump (R-USA) does not. Thanks for clearing that up.

Last week, Republican Texas Gov. Greg Abbott announced that he’s seeking to outlaw viewpoint discrimination on social media.

“I am joining [state Sen. Bryan Hughes] to announce a bill prohibiting social media companies from censoring viewpoints,” the governor said late Thursday night via Twitter. “Too many social media sites silence conservative speech and ideas and trample free speech. It’s un-American, Un-Texan, & soon to be illegal.”

Thank God for Texas.

Freedom of Speech vs. the First Amendment

I am very careful on this blog to make a distinction between the two. Many people try to conflate them, and say that companies like Twitter are free to shut you down, because they’re a private company, and not the government. And the First Amendment only talks about the government.

Yes, that’s technically true, and it’s why I make the distinction. But there’s still a flaw in that reasoning.

Let me give you an example.

Let’s say you’re holding some sort of big political rally, or a protest. You are doing well, the crowd there is completely with you. You’re broadcasting on your YouTube channel and people all over the world are watching.

You are exercising your freedom of speech.

Now, let’s say I’m the head of the local branch of the power company. I don’t like what you’re saying. In fact, I think it’s “hate speech”. I cut your power mid-speech. No one at the rally can hear you anymore. You’re no longer broadcasting on YouTube. Your fans around the world are cut off.

I have just attacked your freedom of speech. I’m a private company, right? You have other ways of getting your message out. What? You didn’t bring backup generators? This is essentially the argument that people make about Twitter.

And it’s essentially true, for what it’s worth. I think this example makes it clear that the argument is ridiculous, though.

And here’s where it gets worse. What if the government looks into it, trying to determine if I have acted unjustly to you? And what if the government decides then that your speech was in fact “hate speech” and sides with me. You’re not going to like that much, are you?

And now at this point, the government has gotten involved and ruled against freedom of speech.

And that, my friend, is an attack on the First Amendment.

What Democrats SHOULD Do Next

After they’ve tackled the election integrity issue, Democrats should move immediately to classify Facebook and Twitter as essential utilities. That would mean that neither would be able to ban verified accounts, or even limit posts by them.

Something like 75 million Americans said they use Facebook as their primary news source. You may not. I may not. But if that many people do, then it must be possible to hear all viewpoints there. This will be another way to allow people to believe in our elections.

Also, as I’ve documented many times, this is a serious freedom of speech issue. Now, I’m not claiming that it’s a First Amendment issue. That only applies to government entities. Even as an essential utility, they are free to run afoul of the First. It may be a Fourteenth Amendment issue, however. Hard to see that conservatives are getting equal protection under the law right now.

And like the issue on election integrity, if the Democrats refuse to tackle this one, it says that they don’t have a problem with Big Tech censorship.

That should make you scared. Very scared.

Remember your Neimöller.

First they came for the socialists, and I did not speak out—
Because I was not a socialist.

Then they came for the trade unionists, and I did not speak out—
Because I was not a trade unionist.

Then they came for the Jews, and I did not speak out—
Because I was not a Jew.

Then they came for me—and there was no one left to speak for me

This is what cancel culture and the crackdowns on free speech are all about. You may not care that some people are being silenced, because you think they’re hateful or spreading disinformation. But next it will be someone else who is described as hateful. And then someone else. And eventually it will be you.

Forget slippery slopes here. We’re halfway down the mountain already. I fully expect the Democrats to do nothing, because those in power are happy with the situation.

Today I weep for America.

The Gestapo Has Arrived Here in America

WATCH: WV State Delegate Apprehended By FBI Gestapo After Livestreaming Capitol Storming

And President Joe Biden (D-USA) hasn’t even taken office yet. Buckle up tight. It’s going to be a bumpy ride.

Irony, Meet Simon & Schuster

S&S have canceled Senator Josh Hawley’s (R-MO) book on censorship.

Brilliant.

From Sharyl Attkinson:

One observer on Capitol Hill who did not wish to be named for fear of retaliation says that corporate and political interests are "working to punish and silence anyone who isn't espousing the correct narratives," particularly those supporting President Trump, and called it a "stunning assault on free speech in America."

Hawley's book, "The Tyranny of Big Tech," was to be published in June. Simon and Schuster has deleted mention of the book on its website.

This is only a “stunning assault on free speech” if you haven’t been paying attention. The left has given up even providing lip service to the idea of free speech for quite some time. This is why I continue to say that I will never even consider voting for a Democrat again for as long as I live.

I am the closest thing to a free speech absolutist that you are likely to ever meet. If you are against free speech then I have no use for you whatsoever.

Chris of Rights Will Always Support Free Speech

My wife is upset with me for my post on Brett Kimberlin last week. I understand why. Aaron Walker was arrested for blogging about Kimberlin. Stacy McCain and his family are in hiding for blogging about Kimberlin. Patterico had police with weapons drawn in his house looking for bodies, and all because he dared blog about Kimberlin. And now, blogger and tweeter who tweets under the handle @ali says his family has been threatened for the crime of supporting the people mentioned above.

So, you can understand why my wife might be upset with me for getting involved in this. I’m only semi-anonymous on this blog. It’s not that hard to find out my real name if you want to do a bit of research. I’ve given enough personal information on this blog that you could certainly find me and my family if you knew my name. She doesn’t want our family to go through what others are going through. And that’s a very reasonable viewpoint. And I don’t want my wife upset with me. The quote “happy wife, happy life” is a true one, after all. Nor do I want my wife and children to be in danger. Particularly over something that I use as more of an expressive outlet than anything else. I know I have very few daily readers, and that doesn’t bother me. That’s never been the point. The point is that I get all of this bottled up inside me, and this is my way of expunging it.

Despite that, I have no intention of lessening my support for Aaron Walker, Patterico, Stacy McCain, @ali, or any one else facing the wrath of Kimberlin and his lackeys.

Why? Am I just crazy?

No. Remember the name of this blog. It wasn’t chosen just to be cute. It’s not just happenstance. As I’ve mentioned numerous times, the Bill of Rights, particularly the First Amendment, are extremely important to me. This isn’t a left/right issue. It’s a right/wrong one. If the roles were reversed, and it was Kimberlin who was attempting to blog, and Patterico, for example, had sent police to his house on a fake 911 call, I would still be writing this, only in support of Kimberlin.

I believe in Free Speech. No matter whose speech it is. The left should be coming out in support of these bloggers as well. They need to be shamed into it, if necessary. Freedom of speech is, in my opinion, the most important of our God-given rights. If you let them take that away from you, then they can take anything away from you, including your life.

You need to understand. What’s going on here is beyond terrifying. I try to avoid comparisons to Nazi Germany. I think they’re overdone. And I think that hyperbole tends to weaken, rather than strengthen your argument. But here the comparisons to the Third Reich are warranted.

This is exactly how it started in the 1930s with the Jews. Jews were targeted, isolated, and attacked. And not just Jews, but the people who came out in support of them. Most of the general citizenry of Germany didn’t agree with this. But it was made clear to them early on what happened to people that spoke up in defense of Jews who were unfairly attacked. So, instead of standing up, they lived in fear that the eyes of oppression would turn next to them. And they did their best to hide from those eyes.

I can’t do that. I’m not trying to be macho here, or pretend that I’m displaying real courage. For me, it’s a decision that I can’t live in shame and in fear. I have to be able to look at myself in the mirror every morning and know that I’m a good person and a good father. I couldn’t do that if I didn’t stand up here.

Kimberlin and his associates are trying to destroy freedom of speech in America. The left, in their silence here, is complicit in this. We cannot allow this to continue.

I have one more link, and I want you to follow it, and read every word. It’s from Ace of Spades HQ. I support his decision, and will be participating in the National Day of Blogger Silence on Friday.

One quote, but do read the whole thing:

On Friday, this site will be absolutely dead-silent, which is what Brett Kimberlin and his stalker crew seeks, and what the media and our supposed Representatives in Congress would permit.

The only post on Friday will be a bold-faced Open Letter to Congress, urging them to act and not attempt to pass the buck to others.

They are our representatives; we would like some representation.

They vowed to defend and protect the Constitution; they can honor that vow now.

I will post links of Congressmen's and Senator's email addresses and offices and phone numbers, and urge every concerned American citizen to let them know, in no uncertain terms, that a crime in progress against the First Amendment (and people's safety) is occurring, and we humbly request they take this seriously.

They are literally going to get someone killed. That is their endgame here.

Will the media and Congress pretend "we didn't know" when this happens?

ABCNews knows.

The Weekly Standard knows.

The Daily Caller knows.

And many, but not yet all, Congressmen and Senators know.

I encourage all bloggers and twitterers to essentially strike that day, or write nothing except your desire that you expect your Congressmen to take threats to your First Amendment rights seriously.

The Candidates and the First Amendment

It’s hard to believe that it’s been almost four years since I last wrote on this. Quite a bit has changed since then, but one thing hasn’t changed. We once again have two candidates running for President from the major parties. So, once again, I’ll be looking at their records from a civil libertarian perspective.

For those that missed this the last time, I examined and compared then Senator Barack Obama (D-IL) and Senator John McCain (R-AZ) based on where they stood on the following issues: First Amendment, Second Amendment, Third Amendment, Fourth Amendment, Fifth Amendment, Sixth Amendment, Seventh Amendment, Eighth Amendment, Eleventh Amendment, Fourteenth Amendment, Fifteenth Amendment, Nineteenth Amendment, Twenty-First Amendment, Twenty-Third Amendment, Twenty-Fourth Amendment, Twenty-Sixth Amendment, Taxes, Abortion, National ID, Voter ID, Card Check, Legalization of Drugs, Gay Rights, Hate Crime Legislation, Growth of Government, Property Rights, Sovereign Rights, Ninth Amendment, and Tenth Amendment. I devoted one post to each of these topics. Some were pretty short, and others were quite long and involved.

Next, I assigned letter grades to each of the two for each item, and at the end produced a weighted final grade. Weightings were necessary, because some of these civil liberties are obviously more important than others. You may be 110% behind gay marriage, but I doubt that even you think that gay marriage is more important then freedom of speech. If you do, you have my sympathies. But I’ll produce a spreadsheet at the end with all my calculations, and you can change the grades and the weightings if you disagree with any of my analysis.

Enough preamble. Let’s get down to it. How do our current Presidential candidates stack up regarding the First Amendment? Like last time, I’ll be looking at information from the First Amendment Center.

Let's quote the First Amendment as a refresher, before we start:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

We’ll start with President Barack Obama (D-USA):

The First Amendment Center is rather kind to Obama, in my opinion.

In its fourth year in office, the Obama administration has a mixed record on issues involving the First Amendment.

[…]

Previously confidential files and rules have since been released for public scrutiny. In 2009, the Justice Department made public the Bush administration 8/1/02 Interrogation Opinion, commonly known as the “torture memos.”

[…]

Still, critics have assailed the administration for not living up to its lofty standards, citing the Justice Department’s refusal to release information concerning domestic wiretapping and surveillance of tourists and U.S. citizens. The department justified the refusal on privacy and national security grounds, according to spokeswoman Tracy Schmaler.

Open-government activists also point to the president’s handling of the Gulf oil spill as an example of unnecessary secrecy. Despite an official government report in 2010 saying the disaster was worse than anticipated, the Obama administration initially presented an overly optimistic portrayal of the cleanup’s success.

[…]

News outlets, including the Associated Press, have criticized the speed with which the administration has met FOIA requests. In 2011, the administration received 544,360 requests but left more than 12,000 of them unmet. Of the cases reviewed, the government denied requests in more than a third of the cases. The administration maintains that it has released more information than past administrations.

[…]

However, relations between the president and religious groups have not always been harmonious. Catholic leaders recently lambasted the administration’s health-insurance mandates requiring religiously affiliated organizations to provide free contraceptive insurance coverage for female employees.

[…]

Though not restrictive of the press, the Obama administration has repeatedly criticized news outlets. The most notable flap occurred in 2009 when White House Communications Director Anita Dunn called the Fox cable network “a wing of the Republican Party.” The president has also sharply criticized news outlets for seeking to gain greater viewership by incorrectly portraying the Washington political scene as combative.

[…]

Reporters have criticized the administration for filing charges against government whistleblowers under the Espionage Act. Invoked six times, the act has drawn criticism for appearing to be a mechanism to hide government misuse of funds.

In 2010, the administration pressed charges against Thomas Drake, a former senior executive at the National Security Agency, for publicly voicing concerns that the government spent an unnecessary amount of money on software when it could have used a cheaper and more effective program.

[…]

In 2010, the president stood as one of the harshest critics of the Supreme Court’s decision in Citizens United v. Federal Election Commission. In the controversial case, the Court upheld the First Amendment rights of labor unions and corporations to fund campaign ads.

Allow me to sum up. The President has been good about disseminating previously “secret” information to the public, when it has furthered his agenda. He has waged war against the Catholic Church, and news organizations that have been critical of the administration, particularly Fox News. He has not pursued implementation of the Fairness Doctrine, which has surprised me. He does support hate crime legislation, which is in direct opposition to freedom of speech.

Finally, there have been numerous reports this year that the Obama administration is keeping an “enemies list” a la former President Richard Nixon (R-USA).

Try this thought experiment: You decide to donate money to Mitt Romney. You want change in the Oval Office, so you engage in your democratic right to send a check.

Several days later, President Barack Obama, the most powerful man on the planet, singles you out by name. His campaign brands you a Romney donor, shames you for "betting against America," and accuses you of having a "less-than-reputable" record. The message from the man who controls the Justice Department (which can indict you), the SEC (which can fine you), and the IRS (which can audit you), is clear: You made a mistake donating that money.

The WSJ may be engaging in a little bit of fear mongering here, but there’s no doubt that this is worrisome behavior from the White House. Still, it’s not like Obama is exposing secrets. All of the donor information is public record, and there’s nothing keeping Daily Kos or Huffington Post or whoever, from doing exactly what Obama has done. It’s just a little different, and a little scarier, when it comes directly from the head of the government.

That’s Obama. Now, let’s look at former Governor Mitt Romney (R-MA):

As Massachusetts governor from 2002 to 2006, Romney proposed legislation that would have exempted religious organizations from having to provide adoption services to same-sex couples.

[…]

In 2005, Romney abandoned plans to exempt Catholic-run hospitals from a state law that requires all hospitals to make the morning-after pill available to “each female rape victim.” Announcing his decision, he said, “I think, in my personal view, it’s the right thing for hospitals to provide information and access to emergency contraception to anyone who is a victim of rape.”

[…]

He did not support a bill to create 35-foot protest-free buffer zones around abortion clinics in his state. Within a year of Romney’s leaving office, his successor, Deval Patrick, signed the legislation.

In the area of campaign finance, Romney vetoed a 2006 bill that would have repealed a ban on printing, publishing or distributing any poster or circular “designed to aid or defeat any candidate for nomination or election to any public office” without identifying individuals who issued or were otherwise responsible for the publication.

Records from Romney’s service as governor became a source of controversy in the 2012 campaign when a Boston Globe article suggested that Romney’s administration tried to purge all e-mail records after his term. According to the report, members of the administration took computers with them and replaced e-mail servers. However, the Associated Press later reported, Massachusetts public-records law doesn’t apply to the governor’s office, so there appears to be nothing illegal in the computer removal. Romney said the messages were deleted because they may have contained confidential information. However, on Dec. 6, 2011, Massachusetts announced that previously closed records from the state’s archives would be made publicly available.

More on his time as head of the 2002 Winter Olympics in Salt Lake City:

At the time, Romney said he supported the designated free-speech zones to promote safety and ease traffic flow. Although the decisions regarding outside protesters fell on city officials, it was later reported that the Olympic committee asked the city to remove two protest zones — which were only large enough to hold 10 people each — located inside the Olympic square. An Olympic committee spokesperson denied that the group made the request.

In addition to the free-speech zones, Romney took a stance on public standards when he set a firm policy on what types of music to play during certain events. For instance, he prohibited music popular among snowboarders from the snowboarding competition because he deemed it too profane.

And as candidate Romney:

In the 2008 and 2012 campaigns, Romney has taken a few stances that directly involve First Amendment principles.

The strongest of these is his position against the McCain-Feingold campaign-finance law: He advocates its repeal.

[…]

In 2007, Romney said, “the American people should be free to advocate for their candidates and their positions without burdensome limitations.” Instead, he said he supports reforms “that promote transparency and disclosure, preserve grassroots activism and protect the ability to criticize or endorse current officeholders and candidates.” He calls McCain-Feingold “burdensome” and “riddled with shortcomings.”

[…]

On the 2012 campaign trail, Romney has continued to oppose campaign-finance regulations, supporting the ability of candidates to collect unlimited donations instead of allowing campaigns to be indirectly supported by money from super PACs. “Let campaigns then take responsibility for their own words,” Romney said in the Jan. 16, 2012, debate in South Carolina.

[…]

In remarks in April 2008, Romney described the goals of the Ocean’s Initiatives: “I’d like to see us clean up the water in which our kids are swimming. I’d like to keep pornography from coming up on their computers. I’d like to keep drugs off the streets. I’d like to see less violence and sex on TV and in video games and in movies. And if we get serious about this, we can actually do a great deal to clean up the water in which our kids and our grandkids are swimming.”

[…]

In the 2012 campaign, Romney has continued to speak in favor of religious freedom. After the Supreme Court unanimously ruled against a Michigan teacher’s challenge to her firing from a Lutheran Church-sponsored school in Hosanna-Tabor Evangelical Lutheran Church and School v. EEOC, Romney voiced his support of the decision to the audience at a Faith and Freedom Coalition event in Myrtle Beach, S.C., saying, “We are very fortunate to have people who are willing to stand up for religious tolerance and religious liberty and the First Amendment of this Constitution in this country.”

Romney has expressed concern about the Obama administration’s treatment of religious liberty, criticizing the Department of Health and Human Service’s decision to require schools and hospitals, including those that are run by the Catholic Church and other faith groups, to cover contraception under their employee insurance plans.

I have to be honest here. Some of the information above surprised me. I’ve done this a few times now, and I generally keep tabs on First Amendment issues. So, I tend to know where major politicians stand regarding the First Amendment. Mitt Romney may be the most friendly major politician to the First Amendment that I’ve ever seen.

Yes, he did require Catholic hospitals to offer the morning-after pill, and he enforced free speech zones at the Olympics, as well as banning some music that he considered profane. Of the three, only the first is all that big of a deal. As the person in charge of the Olympics, his responsibility was to make sure that it went smoothly and was enjoyable to the spectators there as well as at home. His responsibility was not to make sure that people would be able to scream obscenities on national TV. Even with the first, he essentially is saying that religious hospitals can not refuse to provide emergency services based upon their faith.

I’m Catholic, and I’m opposed to the morning after pill and abortions. But from a practical standpoint, I understand his logic here. Still, it does impinge on the freedom of religion, and he’ll be docked a bit for it.

Those of you who read this series in 2008 will recall that I was extremely critical of Mr. Obama on this issue, eventually giving him an ‘F’ letter grade. I have since modified my stance, a little. While it’s clear to me that he’s been no friend of the First Amendment, he hasn’t quite turned out to be the enemy that I feared. Still, he did tell his supporters to “get in their faces” regarding Tea Parties and there is that enemies list.

Still, I’m going to raise his grade from last time, but I will be willing to reconsider, should his campaign start attacking free speech again.

Whew. That’s a lot. what about the grades?

Obama: D (subject to further review)

Romney: B (while he’s terrific compared to his peers, it’s hard to get an ‘A’ on this one)

First Amendment: Advantage Romney.

Results so far:

  Obama Romney
First Amendment D B

Black Is White, Up Is Down, Right Is Wrong, And…

Aaron Walker is in custody as I write this.

Who is Aaron Walker? He’s one of the bloggers who has been harassed by Brett Kimberlin. I’m sure you remember who that is.

He has been taking into custody for violation of the following peace order:

peace-order1-e1338309632429

What did Walker do? He blogged about Kimberlin’s attempt to frame him and silence him. Today a judge agreed with Kimberlin that Walker has no First Amendment rights.

For years now, Glenn Beck has been saying “you will wake up one morning and no longer recognize your country”. Today is the day.

Stacy McCain (who has been forced into hiding, due to being another blogger facing Kimberlin’s wrath) reports:

FROM AN UNDISCLOSED LOCATION
Aaron Walker, whose complaint against convicted terrorist Brett Kimberlin became a conservative cause célèbre this past week, was reportedly taken into custody today after a court hearing in Rockville, Maryland.

One person who attended the hearing in Montgomery County District Court said that Kimberlin asserted that Walker’s continued blogging represented a violation of a “peace order” Kimberlin had obtained against the Virginia attorney, who says Kimberlin tried to “frame” him for assault earlier this year.

During the course of the hearing — which reportedly lasted about an hour — Judge C.J. Vaughey appeared to become increasingly hostile toward Walker, who was taken into custody when the hearing concluded.

On Thursday, May 17, Walker published a 28,000-word account of his experience being targeted by Kimberlin, which soon caught the attention of leading figures in online New Media, including University of Tennessee law professor Glenn Reynolds, who writes the popular Instapundit blog, and bestselling author Michelle Malkin, who warned her readers, “Please remember: Kimberlin is a radical, violent, lying, dangerous felon.”

Further updates may be found on McCain’s blog. As Professor Reynolds says, “read the whole thing”.

Lee Stranahan (one of the organizers behind last week’s “Everyone Blog About Brett Kimberlin Day”) has called for an “Everyone Blog About Aaron Walker Day” – right now.

This affects everyone in America. I have blogged in the past that the left hates free speech. I’ve actually been working on a follow-up to that post, regarding Rush Limbaugh, our President, Media Matters for America and their war on Fox News, and the aforementioned Brett Kimberlin.

I’ll finish that up, but later. This is more urgent. The left will use this victory today against free speech (and make no mistake, that’s what it is) to further their goals of shutting up those who disagree with them. Expect the Kimberlin method to repeated as often and in as many places as possible. Without the protection of the First Amendment, all of our other God given rights are assailable.

The battle lines have been drawn. In the end, there will be no bystanders. You will either fight back against this oppressive government control over your life, or you will fall victim to it.

I, for one, have no intention of being a victim. I stand with Aaron Walker.

UPDATE: More info from Patterico. He paints the same description of the shredding of the First Amendment and it’s implications, but with greater detail. Read here.

Who is Brett Kimberlin?

Today is “Blog about Brett Kimberlin Day”. Living in Indianapolis, I think I have a little bit different perspective on this sociopath than some, so I’m going to talk about his history.

If you know nothing about his present activities, this is the man who has been harrassing (that’s a mild word for it) conservative bloggers. Among his victims are Andrew Breitbart, Patterico, Liberty Chick, Aaron Worthing, & Stacy McCain. All of these people became his victims merely for writing blog posts about this man and his activities. I encourage you to read the links above. I would quote from them, but there’s too much there. I don’t feel I can properly excerpt any of it. But believe me when I say that his tactics against them have been nothing short of chilling.

Remember this scene from “The Untouchables”? Imagine Brett Kimberlin as Frank Nitti, and you’re getting warm. He’s been far worse than Nitti here though.

Anyway, on to the more distant past, and Brett Kimberlin’s initial “claim to fame”.

This is Brett Kimberlin:

Brett C. Kimberlin schemed to elude justice with a series of bizarre plots designed to murder, maim and rob his enemies, create havoc at Speedway and discredit the chief government prosecutor.

…

On sheets of yellow legal pad, Kimberlin asked another inmate in the Marion County Jail to arrange for the murder of Bernard L. (Buddy) Pylitt, the former first assistant U.S. attorney who coordinated his prosecution.

The offer contained a list of 10 names, including a potential prosecution witness, Robert Scott Bixler. Some names had crosses next to them. These indicated those marked for murder, it was learned.

…

“There were six to be killed, two or three to be roughed up and one or two were to be robbed”, a source said.

You might ask exactly what charges Kimberlin was facing and why he’d go to this trouble. Here’s your answer. This is Brett Kimberlin:

It was about ten minutes before 10 p.m. on Sept. 1, 1978 when the first two bombs went off. A third exploded at 10:45. They'd been placed in trash cans and dumpsters and no one had been close enough to be hurt, but the blasts were plenty large enough to do some real damage.

Still, it seemed like it might have been the work of teenage boys, who may have been sufficiently startled by their own handiwork to reconsider how they spent their idle time.

But the next night another bomb went off, and then another.

…

A Speedway High School gym bag had been left by itself, as if forgotten by a player. One of the parents, Carl DeLong, 39, walked over to retrieve it when the bomb went off. His right leg was nearly blown off and his left leg and right hand were severely damaged. Doctors tried to save his leg but had to amputate.

The bomb that maimed Carl DeLong on Sept. 6, 1978 turned out to be the last one, but residents of Speedway didn't know that. Each day people wondered when and where the Speedway Bomber would strike again. As far as the public knew, investigators had no idea who was behind it.

Brett Kimberlin is the Speedway bomber.

The shooter below is not Brett Kimberlin, but believed to have been working for him:

On July 29, 1978, Speedway resident Julia Scyphers, 65, answered a knock at her door. A man she didn't know was standing on her stoop asking about items she'd recently tried to sell at a yard sale. She let him into the garage to look at the items and he shot her in the head.

Mrs. Scypher's husband, Fred, 68, heard the bang and came out in time to see a car pulling out of the driveway. He would later tell police he'd gotten a glimpse of the man who'd come to the door.

Why would Kimberlin want this old lady dead? Good question. This is Brett Kimberlin:

Speedway police were puzzled by the murder. “She had no enemies,” they said.

But she did. Investigators learned her daughter, Sandra Barton was a close…very close friend of Brett C. Kimberlin. The relationship between the pair was complicated by his strange affection for Mrs. Barton’s pre-teen daughter, Debbie

The article I’m quoting was written in 1981. In 1981, that’s how they worded thing like that in the news, “strange affection for Mrs. Barton’s pre-teen daughter.”

Not following me, yet? Let me make it clearer with the following paragraph from the same article. This is Brett Kimberlin:

Investigators learned Debbie accompanied Kimberlin on several long, unsupervised trips, including holidays in Florida, Mexico and Hawaii.

Mrs. Scyphers violently disapproved of Kimberlin’s questionable relationship with Debbie and her mother.

Getting it now? “Strange affection”, “questionable relationship” are euphemisms. The author is trying very hard to state without stating that Brett Kimberlin is a pedophile.

This is also Brett Kimberlin:

Five years later, in 1988, Kimberlin vaulted himself into the national news when he claimed he'd once sold pot to Dan Quayle, then a U.S. Senator from Indiana and candidate for vice president. Quayle vehemently denied the charge and Kimberlin produced no proof beyond making the claim.
Kimberlin was paroled in 1994 after serving about 13 years of his 50-year sentence. But when he made no effort to pay the DeLong judgment his parole was revoked in 1997 and he went back to prison for about four more years, released again in 2001.

Finally, this is Brett Kimberlin:

Kimberlin is the business partner of leftist blogger Brad Friedman who frequently plays fast and loose with the facts. They are both involved with a group called Velvet Revolution which also receives funding from the Tides Foundation.

JTMP has received at least $70,000 in grants from the far-left Tides Foundation since 2006.  The 2006 grant in the amount of $60,000 was for general operations which means JTMP could use the funds without restriction. The 2008 grant of $10,000 was also for general operations.

Another noteworthy donor is singer and liberal activist Barbra Streisand who has given JTMP at least $10,000 through her Barbra Streisand Foundation since 2006 ($5,000 in 2006 for general operations and $5,000 in 2008 for general operations).

Yet another is Teresa Heinz Kerry, wife of Sen. John Kerry (D-Massachusetts).  Mrs. Kerry is CEO of the Heinz Family Foundation which has given JTMP at least $20,000 since 2006 (the grant was earmarked for general operations).

See, the “tolerant” left has no problems being associated with Kimberlin. In fact, the left loves him. Why?

Do the people at the Tides Foundation, Barbra Streisand Foundation, and Heinz Family Foundation know that they have given money to an organization run by a litigious, violent, radical felon who appears to delight in intimidating people whose views he disagrees with?

Oh wait. There’s no point in answering that question in the Obama era, is there?

Because he’s on their side, and he practices politics the Chicago way. Wow, and now we’re back full circle to Frank Nitti.

That is Brett Kimberlin.

Intemperate Thought of the Day #2

President Barack Obama (D-USA), you once called me your “enemy”. It made me pretty mad at the time, as I recall.

Well, maybe I was wrong. Maybe you and I are enemies. I’m the enemy of anyone who is the enemy of the First Amendment, and that clearly describes both you and the rest of the Democrat party.

Keep your hands off my free speech.

ICYMI The First Time-Libs Still Hate Free Speech

Remember, I posted just last week about the ongoing efforts of Democrats to shut up people who disagree with them.

Since then we’ve got four more examples. First something from Florida where college students want to ban Limbaugh and Beck.

You know, I think Keith Olbermann is a loudmouthed obnoxious idiot. And both O’Reilly and Limbaugh can be just a loudmouthed. Chris Matthews is just a lying hypocrite. But I’d never try to shut any of them up, or take down their advertising, or anything like that.

Not so for Media Matters For America, a supposed media watchdog group, who is really just a propaganda arm for the White House. They’ve started a “Drop Fox” campaign, to punish advertisers on Fox News. Their first target? Orbitz. Orbitz drop kicked MMFA with their response:

"This is a political organization that has been funded pretty extensively to go after one network, and we aren't going to engage in that fight," Orbitz spokesman Brian Hoyt said.

"We have a strict policy of tolerance and non-discrimination, and that means we don't favor one political side over another. Tolerance is a two-way street," he said. "We're going to advertise on conservative TV stations, liberal TV stations and -- if there are any out there -- unbiased news broadcasts."

[…]

We haven't bowed to any boycott in the past, and we won't bow to these types of smear campaigns in the future," Hoyt said.

"What they're doing is distorting our record. We don't care about your sexual orientation, religion or gender; we preach tolerance," he said. "Our commitment to the LGBT community should not be at question -- at all."

Incident #3? The new White House Director of Disinformation.

"This week, Jesse Lee will move from the new media department into a role in the communications department as Director of Progressive Media & Online Response," read an internal memo from Communications Director Dan Pfeiffer, provided to The Huffington Post. "For the last two years, Jesse has often worn two hats working in new media and serving as the White House's liaison with the progressive media and online community. Starting this week, Jesse will take on the second role full time working on outreach, strategy and response."

The post is a new one for this White House. Rapid response has been the purview of the Democratic National Committee (and will continue to be). Lee's hire, however, suggests that a portion of it will now be handled from within the administration. It also signals that the White House will be adopting a more aggressive engagement in the online world in the months ahead.

Actually, this isn’t really new. President Barack Obama’s (D-USA) 2008 campaign had something similar. Remember FightTheSmears.org? It’s still there. Waiting to be ramped up again, I’m sure. They also had Linda Douglass asking people to snitch to the White House about any negative stories about ObamaCare. In fact, as assaults on the First Amendment go, this is pretty tame for Obama.

Still, it’s all part of a pattern. Let’s wrap up the pattern with some research by the appropriately named Media Research Center.

They sent Joe Schoffstall to wander around with a pretend petition to “Ban Conservative Hate Sites”:

"The undersigned hereby adamantly demand that the United States government shut down right wing hate sites. The hate speech propagated by sites like the Drudge Report, Hot Air, Instapundit, Big Government, and others must not be allowed to corrupt our political discourse any longer. These sites are dangerous not only to truth and freedom but also to our society as a whole. BAN THEM NOW!"

Only one person refused to sign. This is more just a sad statement about America, than a statement about liberals, though, I must admit.

If you still think these are isolated incidences, you’re dreaming. It’s all part of a pattern, and the pattern is that liberals want to silence the opposition. That’s what the “Fairness Doctrine” is all about. They know their policies can’t stand up to scrutiny, and know that the only way to continue to remain in power is to limit that scrutiny as much as possible.  These won’t be the last items like this you’ll see. In fact, expect to see significantly more between now and next November. Particularly if things don’t appear to be going in favor of the Democrats.

In Case You Missed It–Libs Hate Free Speech

There’s an article in yesterday’s WSJ about the IRS getting political and going after political donations. This is more of the Democrats ongoing plan to stifle free speech.

We wish we were shocked, but the plan is merely the latest play by Democrats to crack down on donors who support their opponents. In 2010 they tried and failed to pass the Disclose Act, which would have forced disclosure on business donations but left unions alone.

This year they've turned to harassment by regulation, first asking the Federal Communications Commission to require groups that run political ads to disclose their high-dollar donors. The Obama Administration is also working up an executive order to require anyone bidding for a federal contract to disclose if the company or its executives donated more then $5,000 to independent groups.

The Democrats want to control every aspect of our lives. They can not do that if we can make our voices heard and fight back. This is why they keep attacking the Tea Party, and why they did everything possible during the ObamaCare debates to make the Tea Party look like rabid angry racist mobs, despite lack of any evidence of such.

This week, President Barack Obama’s (D-USA) handlers smacked down the Boston Herald for refusing to play ball. They published a Mitt Romney op-ed on the front page on the day Obama was visiting Boston, so the Herald was cut out of his fund-raiser. Of course, the op-ed wasn’t exactly the most friendly one to the President:

When Ronald Reagan ran for president in 1980, he hung the Misery Index around Jimmy Carter’s neck. It consisted of the sum total of unemployment and inflation. Today, we have a different set of ailments. Instead of unemployment coupled with inflation, we have a toxic blend of unemployment, debt, home foreclosures, and bankruptcies. Their sum total is what we can call the Obama Misery Index. It is at a record high; indeed, it makes even the malaise of the Carter years look like a boom. Unemployment has fallen, but it’s fallen to a level that is still, by any historical marker, a national disaster. To suggest it as an achievement is to engage in what Daniel Patrick Moynihan famously called “defining deviancy down.”

This isn’t new. The Obama camp hasn’t exactly been friendly to the press lately. A San Francisco Chronicle reporter was booted from the White House press pool for recording a protest with her phone.

Update: In a pants-on-fire moment, the White House press office today denied anyone there had issued threats to remove Carla Marinucci and possibly other Hearst reporters from the press pool covering the President in the Bay Area.

Chronicle editor Ward Bushee called the press office on its fib:

Sadly, we expected the White House to respond in this manner based on our experiences yesterday. It is not a truthful response. It follows a day of off-the-record exchanges with key people in the White House communications office who told us they would remove our reporter, then threatened retaliation to Chronicle and Hearst reporters if we reported on the ban, and then recanted to say our reporter might not be removed after all.

And, they came after a newspaper from Pleasanton, CA for daring to say anything bad at all about the First Lady:

In an email to The Daily Caller, Gina Channell-Allen, president of the Pleasanton Weekly in Pleasanton, California, said that her paper “received a call from the White House asking us to take out part of the story because it reflected poorly on the First Lady.”

[…]

She also wrote a sentence that the White House thought made FLOTUS look snooty.

“Basically the reporter said that the First Lady didn’t speak to the pilots but acknowledged them by making eye contact,” Allen wrote in her email.

Hey, at least none of these people were locked in a closet.

As I said, these aren’t the first times that Obama and his gang have gone after the media when it’s dared to say something he didn’t like. During his Presidential campaign, his supporters went after talk radio. Hard.

Of course, it’s not just the press they want to shut up. It’s all of us. Remember their attacks against the Chamber of Commerce during the lead up to the 2010 elections? I do.

They have to do this, because the political favors and rewards like the ObamaCare waivers are going to be ramped up even more heavily. And they don’t want us to know. Every part of the government is going to be politicized and it’s all going to be about rewarding friends and punishing enemies. And keeping power, in order to continue the process.

However, there’s one way we can fix a lot of this, particularly in terms of the IRS.

Pass the FairTax. No more politicization of tax loopholes for friends and enemies. No more IRS. No problem.
